1. GENERAL TERMS AND CONDITIONS OF SERVICE – VICTOR CAB

1.1 Scope and Nature of Services

Victor Cab acts as a booking center. Its mission is to connect clients (users) with independent professional carriers (partners). Victor Cab specializes in passenger transport as well as light logistics (express delivery of mail and parcels) by road.

1.2 Pricing and Invoicing

Our rates are inclusive of all taxes (including V.A.T.).

  • Claims: Any dispute regarding an invoice must be submitted in writing within 8 days of its issuance date.
  • Payment Responsibility: The ordering party remains the ultimate guarantor of payment, even if a request is made for payment by a third party or the recipient.
  • Additional Costs: In addition to the transport itself, the final price includes all incidental costs incurred during the mission: waiting time, requested detours, parking fees, tolls, and potential storage costs.

1.2.1 Payment Terms

Invoices are payable upon receipt. Any late payment automatically results in the application of interest at the legal rate plus 2%. In the absence of settlement following a formal notice, a fixed indemnity of 15% of the amount due (with a minimum of €50) will be charged for administrative costs and commercial damages.

For « Business » accounts, no fixed fees are applied. Management fees of 5%, 10%, or 15% (depending on the chosen contractual formula) are added to the pre-tax amount of the services.

1.2.2 Digital Payments (Cards, Apple Pay, Google Pay)

  • Verification: When a new card is registered, a test transaction of €1.00 is performed and immediately refunded to validate the payment method.
  • Pre-authorization: For each booking, Victor Cab may perform a temporary hold (authorization) equivalent to 20% of the estimated fare (with a minimum of €5.00). This amount serves to guarantee solvency and cover potential additional costs (waiting time, parking, etc.).

1.2.3 Regulated Pricing (Taxi Ordinance)

In accordance with the Brussels-Capital Region ordinance of October 21, the rates for pre-booked services are as follows:

  • Pickup charge: €1.50
  • Price per minute: €0.40
  • Price per kilometer: €1.50
  • Minimum fare: €8.00
  • Note: Rates may be increased up to a ceiling of 200% of these amounts.

1.2.4 Airport Parking Surcharges

For services to/from airports, actual parking fees are invoiced additionally, based on the official rates of the operators:

  • Brussels Airport (Zaventem): Use of Parking P2.
  • Brussels South Charleroi: Use of Parking Express.

1.3 Cancellation Policy and Client No-Shows

If the client does not appear at the indicated address, a free waiting time (3 min) is granted. After this period, the driver is released and cancellation fees are invoiced.

1.3.1 Brussels Activity Zone

Fees are applied if the driver is already en route and two criteria (elapsed travel time and estimated arrival time) are met. If the driver is already on-site, the elapsed waiting time is added to the cancellation fees.

1.3.2 Outside Brussels Zone

For pickups outside the zone, if the driver has been en route for more than 3 minutes, approach fees proportional to the distance traveled from the center of Brussels are invoiced.

1.3.3 Specific Case: Brussels National Airport (BRU)

  • Driver en route: 30% of the fare.
  • Driver already on-site: 100% of the fare.

1.4 « Fixed Price » Service

Victor Cab may offer a non-negotiable fixed rate. The fixed price becomes void and the fare reverts to the meter if:

  • The wait before pickup exceeds 2 minutes.
  • The client requests an intermediate stop or a wait during the journey.
  • The client modifies the destination or requests a detour during the trip.

1.5 Liability and Jurisdiction

  • Liability: Unless mandatory legal provisions state otherwise, both parties waive the right to bring non-contractual liability actions against each other.
  • Disputes: Only Belgian law is applicable. Any dispute shall fall under the exclusive jurisdiction of the courts of Brussels (French-speaking chambers). For companies, the Enterprise Court (Tribunal de l’Entreprise) has sole jurisdiction.

2. BOOKING OPERATIONS

A « pre-booked » reservation is the registration of a priority request, not the immediate immobilization of a vehicle. The system searches for the most suitable driver approximately 15 minutes before the scheduled time. Victor Cab cannot guarantee absolute availability due to external factors (weather, traffic, strikes).
